Yesterday, 10 Immigration and Customs Enforcement Agents (ICE) filed a Federal lawsuit against the Barack Hussein Obama administration seeking to rescind what an unlawful policy directive from to cease deportation of illegal immigrants.   Ice agents are being suspended for retaining illegal immigrants, even if there are outstanding warrants against them. If an agent retains any illegal a second time, he is in jeopardy of losing his job!

The agents believe that if  such a stand was taken  against “Fast and Furious”, fellow  Border Patrol agent Brian Terry would be alive today.

Immigration agents file suit against Napolitano over ‘amnesty’ program

Ten federal immigration agents have filed suit against Homeland Security Secretary Janet Napolitano claiming recent directives are forcing them to break the law and ignore their duties when it comes to deporting illegal immigrants. The suit was filed Thursday in Texas federal court by Immigration and Customs Enforcement officials. It challenges recent directives allowing some illegal immigrants — particularly non-felons and those who came to the U.S. as children — to stay and, in some cases, get work permits.

The suit, obtained by Fox News, says the agents are being forced to “violate federal law.” It says the new directive “unconstitutionally usurps and encroaches upon the legislative powers of Congress.” ICE Director John Morton is also named as a defendant. Kris Kobach, lead attorney on the case, equated the move to give thousands of illegal immigrants a reprieve to the failed Fast and Furious gun-walking operation. “In both instances, the Obama administration ordered federal law enforcement agents to break the law, to ignore the laws that they’re supposed to enforce, and, in the case of the ICE agents, to actually break federal laws that say you’re supposed to deport certain people,” he said. “And in each case, the Obama administration seems to be doing so for political reasons.” Kobach, the Kansas secretary of state, is also an adviser to Mitt Romney and a co-author of the Arizona illegal immigration law. Napolitano defended the new rules during testimony last month before the House Judiciary Committee. “These policies promote the efficient use of our resources ensuring that we do not divert them away from the removal of convicted criminals by pursuing the removal of young people who came to this country as children and who have called no other country home,” she said. The Supreme Court has recognized the ability of the federal government to use what’s known as “prosecutorial discretion” in the enforcement of immigration law. In the recent case over the Arizona immigration law, the court defended the government’s ability to make “some discretionary decisions.” In the suit, the agents are asking a federal judge to block the directives in question, saying they amount to an end-run around Congress and violate the separation of powers between the Legislative and Executive branches. Republican lawmakers released a flurry of statements Thursday backing up the suit and challenging the administration policy. “The Obama administration’s amnesty program not only rewards lawbreakers, it also forces ICE agents to violate federal law. ICE agents should enforce our immigration laws and apprehend illegal immigrants. But the Obama administration makes it impossible for ICE agents to do their jobs,” House Judiciary Committee Chairman Lamar Smith, R-Texas, said in a statement.

Obama administration is moving to shut down nine Border Patrol stations across four states

The Obama administration is moving to shut down nine Border Patrol stations across four states, triggering a backlash from local law enforcement, members of Congress and Border Patrol agents themselves.

The stations that will be closed — most of which are in Texas — are:
 
— Abilene, Texas;
 — San Angelo, Texas;
 — Riverside, California;
 — Dallas, Texas;
 — San Antonio, Texas;
 — Lubbock, Texas;
 — Amarillo, Texas;
 — Billings, Montana;
 — And Twin Falls, Idaho.
 
But the Federation for American Immigration Reform said the interior stations are a needed “second line of defense” to track down and apprehend illegal immigrants who make it past international borders and into heavily traveled corridors in the United States.
Critics of the move warn the closures will undercut efforts to intercept drug and human traffickers in well-traveled corridors north of the U.S.-Mexico border. Though the affected stations are scattered throughout northern and central Texas, and three other states, the coverage areas still see plenty of illegal immigrant activity — one soon-to-be-shuttered station in Amarillo, Texas, is right in the middle of the I-40 corridor; another in Riverside, Calif., is outside Los Angeles.
 
U.S. Customs and Border Protection says it’s closing the stations in order to reassign agents to high-priority areas closer to the border.
 
“These deactivations are consistent with the strategic goal of securing America’s borders, and our objective of increasing and sustaining the certainty of arrest of those trying to enter our country illegally,” CBP spokesman Bill Brooks said in a statement. “By redeploying and reallocating resources at or near the border, CBP will maximize the effectiveness of its enforcement mandate and align our investments with our mission.”
 
But at least one Border Patrol supervisor in Texas has called on local officers to “voice your concerns” to elected officials, warning that the “deactivation” will remove agents from the Texas Panhandle, among other places. Several members of Congress have asked Border Patrol Chief Michael Fisher to reconsider the plan. And local officials are getting worried about what will happen once the Border Patrol leaves town, since they rely on those federal officials to assist in making immigration arrests.
 
“It could impact us tremendously since we’ve only got two agents up here now for 26 counties,” Potter County Sheriff Brian Thomas told FoxNews.com.
 
Potter County, in the Texas Panhandle, would be affected by the planned closure of the Amarillo station.  
 
Thomas said that while his area is far from the border, it’s still a major “corridor” for illegal immigrants — and he said his office depends on Border Patrol to respond to their calls.
 
“I can’t hold a carload of people out there on I-40 for eight hours while somebody comes from El Paso,” he said. “I mean, that’s just crazy.”
 
Border Patrol’s resident agent in charge in Amarillo expressed similar worries, in a recent memo to local law enforcement alerting them to the planned closure. The official, Robert Green, warned that the “entire complement” of two agents would be reassigned from Amarillo to somewhere closer to the border. He said “there is no active plan” right now for Immigration and Customs Enforcement to fill the void on assisting local officials with stops.
Empathizing with local officials, he wrote: “As a former deputy I found myself on the other end of the radio hoping to contact USBP to assist me with a vehicle full of undocumented foreign nationals on the side of the road.”
 
And in an unusual plea, he urged the recipients of his memo to contact elected officials about the change. “I would encourage you, if you have found USBP assistance valuable in the past, to contact your political representatives and voice your concerns,” Green wrote.
 
The letter was first posted online by the Lubbock Avalanche-Journal. Thomas confirmed to FoxNews.com that he received it. Bob Dane, communications director with the Federation for American Immigration Reform, also said he’s confirmed the letter’s authenticity with ICE.
CBP later acknowledged the memo, but said in its statement that Green was expressing his “personal opinion.”
 
Lawmakers have started to get involved. Republican Rep. Mac Thornberry, who represents Amarillo, joined two other Texas lawmakers whose districts would be affected in asking the Border Patrol chief to “reconsider the proposal.”
 
A letter sent Tuesday to Fisher warned the plan would “leave our area vulnerable.” They noted that the Amarillo and Lubbock stations alone, two of those affected, accounted for 638 apprehensions of illegal immigrants just this year.
 
FAIR also blasted the Obama administration for the plans.
 
“It’s part of the systematic dismantling of both border and interior enforcement,” Dane told FoxNews.com. “It complements the non-enforcement policy of this administration.”
 
He warned that local officials in those areas will have a hard time summoning far-away Border Patrol agents to assist, and said the tone of Green’s memo was a “not-so-subtle shout-out” that the agency feels “outmanned, outgunned … by their own government.”
 
The stations set for closure in about six months include six in Texas. They are in: Lubbock, Amarillo, Dallas, San Angelo, Abilene and San Antonio. The other three are in Billings, Mont.; Twin Falls, Idaho; and Riverside, Calif.
 
Brooks said that the closures do not mean agents will be out of contact.   
 
“Though Border Patrol agents would no longer be located in these areas, the Border Patrol intends to maintain strong and meaningful law enforcement partnerships with Immigration and Customs Enforcement and local law enforcement agencies in these areas through continuing to actively share intelligence and information” and other avenues, he said.
 
Detractors, though, say the changes are part of a pattern. The administration recently announced it would stop deporting young illegal immigrants who came to the U.S. as children and have not committed a serious crime. And after the Supreme Court upheld one plank of Arizona’s controversial immigration enforcement law last month, federal officials said ICE would be selective in responding to calls about immigration status – prioritizing cases that meet certain criteria, like whether the suspect is wanted for a felony.
 
Rep. Randy Neugebauer, R-Texas, who signed the Thornberry letter, also voiced concern about the latest announcement on station closings in a written statement.
 
“The Department of Homeland Security hasn’t demonstrated that sending additional resources to the border will be a more efficient use of resources than maintaining a presence further north,” Neugebauer said. “I’d like to see numbers that reassure me that this strategy change won’t ultimately result in fewer arrests.”

It’s one thing to tell civilian employees to cower under a desk if a gunman starts spraying fire in a confined area, say members of Tucson Local 2544/National Border Patrol Council, but to give armed law enforcement professionals the same advice is downright insulting. The instructions from DHS come in the form of pamphlets and a mandatory computer tutorial.
 
“We are now taught in an ‘Active Shooter’ course that if we encounter a shooter in a public place we are to ‘run away’ and ‘hide’” union leader Brandon Judd wrote on the website of 3,300-member union local. “If we are cornered by such a shooter we are to (only as a last resort) become ‘aggressive’ and ‘throw things’ at him or her. We are then advised to ‘call law enforcement’ and wait for their arrival (presumably, while more innocent victims are slaughtered).”
 
The FEMA-administered computer course, entitled “IS-907- Active Shooter: What You Can Do,” is a 45-minute tutorial that provides guidance to all employees on how to recognize indicators of possible workplace violence and what to do should their office be invaded by gunmen and focuses around three main options; either evacuate, hide out, or in dire circumstances, take action.
Once the course is completed, employees are urged to download additional materials including a summary booklet and pocket-sized card outlining protocol, which was also handed out to employees two months ago.
 
One DHS employee told FoxNews.com the instruction cards were handed out to employees six weeks ago. At the time, he assumed they were only for civilian employees, not armed law enforcement officers within the department, which oversees the U.S. Customs and Border Protection.
 
“Requiring BP agents to follow the same steps is egregious,” he said.
 
DHS officials maintain that the Active Shooter course was designed for all employees—civilian and law-enforcement officers– and no one should rush into a situation where they, or others around them, could get hurt.
 
“The Department of Homeland Security takes very seriously its responsibility to protect all of its employees from threats that may surface in the workplace,” U.S. Customs and Border Protection spokesman Michael Friel said in a written statement to FoxNews.com
 
“CBP workforce training is designed to prepare all employees, including leaders, managers, supervisors, law enforcement personnel and non-law enforcement personnel, to understand their own roles and the roles of their fellow employees in responding to threats. In an active shooter scenario, employees are taught to take actions that keep them alive.”
 
But members of Local 2544 say they are obligated to protect the public in such a situation, whether they are on duty or not. Given the instructions, some wonder if they would be disciplined for taking down a gunman in a situation like the Fort Hood shooting or the January, 2011 case in Casa Adobes, in which a deranged gunmen shot 19 people, including Democratic Rep. Gabrielle Giffords. Six people were killed.
 
“It is always comforting to know that for those of us who carry a weapon when we are off-duty, if we should encounter such a situation, stop a shooter and save countless lives, we can look forward to being disciplined or fired by the Border Patrol because we should have run away to hide and then maybe thrown objects at the deranged killer instead of taking action and stopping him with a firearm,” the union local’s website says.
