Senate Conservatives Gather Enough Votes to Block Lame Duck Treaties

A group of Senate conservatives has gathered enough support to block any treaties that come up for a vote during the lame duck session.

A total of 36 Senators pledged, in a letter drafted by Sens. Mike Lee (R-UT) and Pat Toomey (R-PA) to Majority and Minority leaders Harry Reid (D-NV) and Mitch McConnell (R-KY), to “oppose efforts to consider a treaty during” the lame duck session.

Because treaties require a two-thirds majority in the Senate to reach the president’s desk, the group of Senators will be able to block any treaties considered after the Nov. 6 election.

“The writers of the Constitution clearly believed that all treaties presented to the Senate should undergo the most thorough scrutiny before being agreed upon,” the letter states. “The American people will be electing representatives and senators in November, and the new representatives carrying the election mandate should be afforded the opportunity to review and consider any international agreements that are outstanding at the time of their election.”

Some Senators had expressed hope that their house would ratify the U.N. Convention on the Law of the Sea (commonly known as the Law of the Sea Treaty) in a lame duck session. The treaty was blocked earlier this year by Senators who noted that it would cede some level of U.S. sovereignty to an international body, force the United States to forgo some level oil and gas royalty revenue, and would produce few tangible benefits.

The Heritage Foundation’s Steve Groves testified on LOST before the Senate Foreign Relations Committee.

A U.N. treaty on persons with disabilities may also be considered during a lame duck session. Lee this week blocked an attempt to pass that treaty by unanimous consent. “For various reasons we don’t think any treaty should come up during the lame duck time period and we will continue to oppose any treaty passage,” Lee said. “If it is true that it is too fast to move a treaty through during a lame duck, then it’s also too fast to move it through now.”

 As you can see from the foregoing link,  Senator Scott Brown was a signatory to the Pledge that clearly stated that , “We request that no treaties be brought to the Senate floor during a lame-duck period, and will oppose efforts to consider a treaty during this time.”

 Today, our Senator Scott Brown broke his pledge, voted for the CRPD Treaty and demonstrated his treachery.

The Preamble to the Rules of the Republican Party state, “Be it resolved, that the Republican Party is the party of the Open door. Ours is the party of liberty, the party of equality, of opportunity for all, and favoritism for none. It is the intent and purpose of these rules to encourage and allow the broadest possible participation of all voters in Republican Party activities at all levels and to assure that the Republican Party is open and accessible to all Americans.”

As the committee was ready to adjourn yesterday, Florence Sebern, delegate from Colorado, bravely moved to strike the Preamble, as, “It’s inconsistent with what we did today.”

Her succinct comment was appropriate, and reflected in Jeremy Blosser’s comments today. Blosser, a delegate from Texas, has been attending all the GOP committee meetings coordinating, and encouraging liberty delegate members, in their efforts to bring fairness to the RNC. He writes:

“Manipulating concerns of many in the party mainstream over the success Ron Paul’s supporters had becoming delegates this cycle, the DC insiders led by the Romney campaign are staging a complete takeover of the national Republican Party from the conservative wing and ensuring they will never lose power again.”

Romney campaign attorneys and other operatives ran a large set of changes through the convention rules committee on Friday. The vast majority of which were not discussed prior in the RNC Standing Rules committee. Two changes stand out far beyond the rest and must be defeated on the floor of the convention if we do not want to see the grassroots shut out of the party for decades to come.

First, the committee voted to allow the RNC to make rule changes between conventions, with little to no checks or balances. The original threshold proposed was 2/3 of the entire RNC. Melinda Fredericks of Texas got this changed to 3/4, but as Morton Blackwell of Virginia noted, in his many years on the RNC he has never seen a situation where the chairman did not get what he wanted on a vote, regardless of threshold.

Second, the committee voted to dramatically restrict who can be elected a delegate to the national convention. All states now are required to pledge all delegates, and all national delegates must be approved by the candidate they are pledged to. As originally proposed, the candidate had to pre-approve people before they could run, but this was changed to instead give candidates veto power over elections. Attempts to carve out exceptions for caucus states that have party rule requiring they not pledge some delegates failed.

I’m pleased to say our representatives on the committee opposed this one as strongly as anyone did, with Butch Davis saying that stopping it was “a hill to die on”. David Barton ran for the Platform Committee so that he could make sure the Romney campaign would not successfully gut the platform–that kind of speech or position will never be tolerated in the future if this stands.

Morton Blackwell and others are leading efforts to defeat this via minority reports on the floor. We NEED to make sure either those pass or the entire report is voted down so we stay with the 2008 rules. PLEASE help us inform the delegates and put pressure where needed to stop this. This is not a “Ron Paul vs mainstream GOP” thing, this is a complete party takeover by the DC insiders we may not be able to reverse if it succeeds.

The last form of the adopted language I have available is below–we don’t have access to the official report yet but unless I missed something this is it.

New rule inserted as number 12:

“The Republican National Committee may, by three fourths (3/4) vote of its entire membership, amend Rules 1-11 and 13-24. Any such amendment shall be considered by the Republican National Committee only if it was passed by by a majority vote of the Standing Committee on Rules after having been submitted in writing at least ten (10) days in advance of its consideration by the Republican National Committee and shall take effect thirty (30) days after adoption. No such amendment shall be adopted after September 30, 2014.”

New rule inserted as number 15(a):

15(a)(1) Any statewide presidential preference vote that permits a choice among candidates for the Republican nomination for president of the United States in a primary, caucus, or state convention must be used to allocate and bind the state’s delegation to the National Convention in either a proportional or winner-take-all manner, except for delegates and alternate delegates who appear on a ballot in a statewide election and are elected directly by primary voters.

15(a)(2) For any manner of binding or allocating delegates permitted by these Rules, no delegate or alternate who is bound or allocated to a particular presidential candidate may be certified under Rule 19 if the presidential candidate to whom the delegate or alternate delegate is bound or allocated has, in consultation with the State Party, disavowed the delegate or alternate delegate.

15(e)(3) The Republican National Committee may grant a waiver to a state Republican Party from the provisions of 15(a) and (b) where compliance is impossible, and the Republican National Committee determines that granting such a waiver is in the best interests of the Republican Party.

If these rules pass as the committee passed them, the Republican Party will be completely closed to the grassroots. The only way to fix it will be to take over the RNC, because we won’t likely be able to get into the national convention as delegates again. We’ll certainly do that if it’s the only option they leave us, but we have to defeat these rule changes if we want to fulfill our mandate to affect the national party in this cycle.

For this change to take effect it has to be approved by a vote of the entire convention on Monday (now Tuesday, as the convention opening has been postponed to early Tuesday afternoon because of the hurricane).

Pat Kerby, delegate from Nevada, had this to say, “With their change to the rules giving them “flexibility,” can’t they just change it to whatever suits them? The days of the grassroots having input in the GOP are over until the grassroots are the majority.”

Particularly scary is that the treaties, once signed and ratified, have the same status as constitutional law and cannot be altered or eclipsed by Congress or state legislatures. And their provisions must be enforced by U.S. courts.

Those who wish to preserve our sovereignty and democratic control over our future must rally to block these treaties, either by pressing Obama and Clinton not to sign them or by blocking their ratification.

The Law of the Sea Treaty (LOST) has been signed, and the Obama administration — with the aid of RINO Sen. Richard Lugar (Ind.) — will push for its ratification as soon as Lugar’s primary in Indiana is over this year. LOST requires that the United States pay an international body half of its royalties from offshore drilling. The body would then distribute the funds as it sees fit to whichever nations it chooses. The United States would only have one vote out of 160 regarding where the money goes. LOST will also oblige us to hand over our offshore drilling technology to any nation that wants it … for free. Our own Senator Kerry is leading the charge for this treaty on behalf of the Obama Administration! Senator Kerry has held hearings on the Treaty and allowed 16 People to testify in favor of the treat and only 2 people to testify against the treaty. He is playing hardball, perhaps he is seeking favor to lock in his next venue as part of the Obama Administration, should they prevail in November! The word on the street from reliable sources is that Republican Senators who face an election in November have told Senator Kerry that if the treaty is brought up for a vote before November 6th hey would have to vote nay, but after they would vote yea! Ala Obama to Russia’s President Medvedev on an open mic.

Small-arms control Clinton is about to negotiate on a global ban on export of small arms. It would only apply to private citizens but, of course, most small-arms deals come not from individuals or private firms but from governments, specifically those of the United States, Russia, China and Israel. The treaty would require each nation to adopt measures to stop exportation of small arms. It is easy to see how this could be a backdoor way to require national registration of all guns and to assert federal regulation over firearms. It would also require the registration of all ammunition to track its source once a gun is fired. The Second Amendment be damned!

Outer Space Code of Conduct — Under the guise of stopping debris from accumulating in outer space, the European Union has enlisted Clinton in negotiations over a code of conduct. The code would prohibit activities that are likely to generate debris in outer space — space littering. The code might inhibit or prohibit the United States from deploying anti-missile missiles on platforms in space, denying us the key weapon we need to counter Iranian, Chinese and North Korean missile threats. European leftists reacted angrily when G.W. Bush opted out of the ABM treaty banning defensive weapons. Now they seek to reimpose it under the guise of a code of conduct.

Rights of the Child — Even more fanciful is a treaty Clinton plans to negotiate setting forth a code of rights for children, to be administered by a 14-member court set up for the purpose. The draft treaty obliges rich nations to provide funds for shelter, food, clothing and education for children in poor nations. This provision could create grounds to litigate to challenge the level of foreign aid we give as inadequate to meet our treaty obligations. Already, leftists in the United Kingdom are using the treaty to attack welfare cuts by the Cameron government.

CONVENTION on the RIGHTS of PERSONS with DISABILITIES

Our very own SENATOR KERRY once again is advocating for “…the global community[which] could force America to sanction sterilization or abortion for the disabled–at taxpayer expense! Sen. Marco Rubio (R-Fla.) tried to neutralize the threat yesterday during the mark-up in the Senate Foreign Relations Committee. Unfortunately, his amendment (which would have stopped the treaty from forcing abortion policy on countries that sign) was thwarted by Sen. John Kerry (D-Mass.)

It’s the latest threat to parents’ rights that no one knows about–and yesterday, the Senate moved one step closer to making it the law of the land. Like most U.N. treaties, this one sounds harmless enough. But make no mistake–its innocuous name, Convention on the Rights of Persons with Disabilities (CRPD), masks a cunning attack on parental authority, unborn life, and U.S. sovereignty. Of course, this is a favorite strategy of liberal administrations: using treaties to get radical policies through the country’s backdoor. In this instance, it would bring our nation even closer to President Obama’s apparent goal of putting America under global governance.

As Phyllis Schafly points out, the U.S. already enacted the strongest piece of disabilities legislation in the world. This idea that the U.N. “can provide more benefits or protections for persons with disabilities than the U.S. is bizarre,” she writes in an excellent column that debunks the need for such a treaty. “The United States always treats individuals, able or disabled, rich or poor, innocent or guilty, better than any nation.” Democrats argue that it would help the rest of the world “catch up” to our standards. But, as Sen. Jim DeMint and others have made clear, the U.S. doesn’t need to sign away its rights to provide leadership in that area.

While this is a noble cause that embodies the American ethic–treating people with dignity and respect–it gives the U.N. a profound stake in U.S. law and the rights of people across the country. Specifically, the CRPD takes aim at parents, declaring that an international body–not moms and dads–will be the ultimate authority on issues like education. The treaty slips in phrases like “best interest of the child,” which, as Sen. Rick Santorum pointed out with me on last week’s radio show, are “red alert alarm words.” They mean that government officials or courts will be in the position of deciding what’s in your child’s best interest–not you. Under CRPD, the government would supersede parents in setting course plans for both gifted and special needs kids. The Homeschool Legal Defense Association is concerned–and rightly so. It maintains that this Convention signals a dramatic turnaround in parental rights.

Although Sen. DeMint managed to delay the CRPD a week, the Committee, including three of its Republicans–Sens. John Barrasso (Wy.), Richard Lugar (Ind.), Johnny Isakson (Ga.)–voted yesterday to send the treaty to the Senate floor, where it could be ratified as early as next week. Between now and then, it is absolutely critical for people to see that what’s at stake in this debate, which is nothing short of our authority as parents–and as a nation. By law, the Convention will need 67 votes to pass, which means we need to persuade at least 34 senators to defeat it. Word on the street from reliable sources is that Our Senator Kerry will attempt to push this Treaty thru the Senate in early September as soon as they return to Washington. How did the Romans grow grapes in northern England? Perhaps because it was warmer than we thought.

A study suggests the Britain of 2,000 years ago experienced a lengthy period of hotter summers than today.

German researchers used data from tree rings – a key indicator of past climate – to claim the world has been on a ‘long-term cooling trend’ for two millennia until the global warming of the twentieth century.

This cooling was punctuated by a couple of warm spells.

These are the Medieval Warm Period, which is well known, but also a period during the toga-wearing Roman times when temperatures were apparently 1 deg C warmer than now.

They say the very warm period during the years 21 to 50AD has been underestimated by climate scientists.

Lead author Professor Dr Jan Esper of Johannes Gutenberg University in Mainz said: ‘We found that previous estimates of historical temperatures during the Roman era and the Middle Ages were too low.

‘This figure we calculated may not seem particularly significant, however it is not negligible when compared to global warming, which up to now has been less than 1 deg C.’

In general the scientists found a slow cooling of 0.6C over 2,000 years, which they attributed to changes in the Earth’s orbit which took it further away from the Sun.

The study is published in Nature Climate Change.

It is based on measurements stretching back to 138BC.

Professor Esper’s group at the Institute of Geography at JGU used tree-ring density measurements from sub-fossil pine trees originating from Finnish Lapland to produce a reconstruction reaching back to 138 BC.

In so doing, the researchers have been able for the first time to precisely demonstrate that the long-term trend over the past two millennia has been towards climatic cooling.

Professor Esper said: ‘Such findings are also significant with regard to climate policy, as they will influence the way today’s climate changes are seen in context of historical warm periods.’

The annual growth rings in trees are the most important witnesses over the past 1,000 to 2,000 years as they indicate how warm and cool past climate conditions were.

Researchers from Germany, Finland, Scotland, and Switzerland examined tree-ring density profiles.

In the cold environment of Finnish Lapland, trees often collapse into one of the numerous lakes, where they remain well preserved for thousands of years.

The density measurements correlate closely with the summer temperatures in this area on the edge of the Nordic taiga; the researchers were thus able to create a temperature reconstruction of unprecedented quality.

The reconstruction provides a high-resolution representation of temperature patterns in the Roman and Medieval Warm periods, but also shows the cold phases that occurred during the Migration Period and the later Little Ice Age.

In addition to the cold and warm phases, the new climate curve also exhibits a phenomenon that was not expected in this form.

UNITED NATIONS –  A little more than a week after accusing Iran of supplying arms for Syria’s bloody crackdown on democracy-minded rebels, the UN has given Tehran a key seat at negotiations for a global arms treaty.

The stunning appointment by member states attending the UN Conference of the Arms Trade Treaty in New York came last week, and is just the latest example of the world body appointing rogue and repressive regimes to leadership roles. The 15-nation committee to which Iran was appointed hopes to guide what could eventually become the first legally binding global treaty aimed at regulating the international trade of conventional arms.
 
Critics say asking Iran to help craft a treaty aimed at stopping arms proliferation to terrorist groups and rogue states makes a mockery of the talks. Just two weeks ago, the UN Security Council accused Tehran of shipping arms to Syria, and Iran is also suspected of hiding illegal nuclear weapons facilities from international watchdogs.

“Right after a UN Security Council report found Iran guilty of illegally transferring guns and bombs to Syria, which is now murdering thousands of its own people, it defies logic, morality and common sense for the UN to elect this same regime to a global post in the regulation of arms transfers,” UN Watch Executive Director Hillel Neuer told FoxNews.com.
 
Talks are taking place throughout the month, with Argentina serving as president and the other 14 nations, including the U.S., Iran, China and Russia, as deputies, or vice presidents. The treaty would regulate conventional arms and not weapons of mass destruction, such as nuclear, chemical or biological arms.
 
Any treaty would have to be ratified by the Senate in order to be enforceable against U.S. citizens or corporations. The talks have already raised concerns in the U.S. that an international pact could curb Americans’ Second Amendment rights. The conference was backed by the Obama administration, in a reversal of the Bush administration, which had opposed a UN General Assembly resolution launching the treaty process in 2006.
 
Iran gloated about its appointment, with its news agencies IRNA and ISNA boasting about the Islamic Republic’s appointment as a “deputy” to the treaty talks, and the Tehran Times touting that Iran’s mission to the UN will be “assisting the president” of the conference in conducting business.
 
At the meeting in which Iran was named to the committee, no nations — including the U.S. — objected. But the U.S. State Department scrambled to play down the significance of the appointment, arguing there are safeguards protecting against any treaty not in the U.S. interest from being passed. 
 
“Obviously we oppose [Iran’s appointment], but it’s a symbolic position with little impact on a month-long negotiation that must be decided by consensus,” said one senior State Department official, who asked not to be identified because a more formal response was still being prepared.
 
“It will ultimately face the approval of the United States regardless of which country holds one of 14 powerless vice president positions. At that point, we will be looking for an arms trade treaty that makes the legitimate global weapons trade safer by bringing the rest of the world’s arms trade regulations up to the high [current] U.S. standard.”
 
Just last year, Ambassador Joseph Torsella, the Obama administration’s U.S. Representative to UN for Management and Reform, told the Council on Foreign Relations the U.S. would no longer go along with appointments that send the wrong message.
 
“We’re going to assert a common-sense principle across the UN: If a member state is under Security Council sanction for weapons proliferation or massive human-rights abuses, it should be barred, plain and simple, from leadership roles like chairmanships in UN bodies,” Torsella said. “Abusers of international law or norms should not be the public face of the UN.”
 
UN Secretary General Ban Ki-moon addressed the arms trade conference on the same day as Iran’s appointment, but failed to mention it.
 
Instead he focused the need for an arms trade treaty to advance in tandem with efforts to control the proliferation of nuclear and other weapons of mass destruction.
 
“Nuclear issues capture headlines, but conventional arms are killing people every day,” Ban told the UN’s 193 member states.
 
Significantly, Iran is also defying the UN over pursuit of its nuclear program, which the West believes is aimed at developing a nuclear weapon.
 
Conference spokesman Ewen Buchanan said the choice of Iran was solely that of the Asia-Pacific group, and stressed the conference secretariat was “not in charge of this member-state process.”
 
The conference is taking place after the Obama administration moved in 2009 to support holding the event – reversing the position of the Bush administration, which opposed a UN General Assembly resolution launching the treaty process in 2006.
 
The U.S. has long listed Iran as a state sponsor of terrorism, and both it and Israel accuse the Islamic Republic of providing support to Mideast terror groups that seek Israel’s destruction.
 
Meanwhile, incongruous appointments take place with alarming frequency at the UN, and include Syria’s appointment to a UNESCO human rights committee last fall, and Saudi Arabia’s earlier appointment to the board of the women’s rights agency UN Women – despite laws in the Arab kingdom that don’t even allow women to drive.
 
Syria, meanwhile, is quietly competing to become a member of the UN Human Rights Council – which the UN bills as the world’s foremost arbiter of human rights violations.
 
“The UN’s choice of Iran is exactly why we fear that Syria’s declared bid for a UN Human Rights Council seat is not impossible,” said Neuer, whose organization also uncovered the Syrian candidacy.

President Obama and Secretary of State Hillary Clinton are entering negotiations over — or seeking ratification of — five treaties that could radically limit our national sovereignty and the reach of our democratic institutions. Particularly scary is that the treaties, once signed and ratified, have the same status as constitutional law and cannot be altered or eclipsed by Congress or state legislatures. And their provisions must be enforced by U.S. courts.

Those who wish to preserve our sovereignty and democratic control over our future must rally to block these treaties, either by pressing Obama and Clinton not to sign them or by blocking their ratification.

• International Criminal Court — Clinton has reversed George W. Bush’s policy and entered into negotiations over U.S. participation in the court. Specifically, the leftists who are sponsoring the court wish to create a new crime of “aggression,” which is essentially going to war without the approval of the United Nations. If we submit to the court’s jurisdiction, our presidents and Cabinet officials could be prosecuted criminally for going to war without U.N. approval. This would, of course, give Russia and China a veto over our military actions. Clinton says she will stop our military’s hands from being tied, but we all must realize that once we accept the International Criminal Court, we go down a slippery slope. The court could even prosecute Americans who have been cleared by our own judicial system.

• The Law of the Sea Treaty (LOST) has been signed, and the Obama administration — with the aid of RINO Sen. Richard Lugar (Ind.) — will push for its ratification as soon as Lugar’s primary in Indiana is over this year. LOST requires that the United States pay an international body half of its royalties from offshore drilling. The body would then distribute the funds as it sees fit to whichever nations it chooses. The United States would only have one vote out of 160 regarding where the money goes. LOST will also oblige us to hand over our offshore drilling technology to any nation that wants it … for free.

• Small-arms control — Clinton is about to negotiate on a global ban on export of small arms. It would only apply to private citizens but, of course, most small-arms deals come not from individuals or private firms but from governments, specifically those of the United States, Russia, China and Israel. The treaty would require each nation to adopt measures to stop exportation of small arms. It is easy to see how this could be a backdoor way to require national registration of all guns and to assert federal regulation over firearms. It would also require the registration of all ammunition to track its source once a gun is fired. The Second Amendment be damned!

• Outer Space Code of Conduct — Under the guise of stopping debris from accumulating in outer space, the European Union has enlisted Clinton in negotiations over a code of conduct. The code would prohibit activities that are likely to generate debris in outer space — space littering. The code might inhibit or prohibit the United States from deploying anti-missile missiles on platforms in space, denying us the key weapon we need to counter Iranian, Chinese and North Korean missile threats. European leftists reacted angrily when G.W. Bush opted out of the ABM treaty banning defensive weapons. Now they seek to reimpose it under the guise of a code of conduct.

• Rights of the Child — Even more fanciful is a treaty Clinton plans to negotiate setting forth a code of rights for children, to be administered by a 14-member court set up for the purpose. The draft treaty obliges rich nations to provide funds for shelter, food, clothing and education for children in poor nations. This provision could create grounds to litigate to challenge the level of foreign aid we give as inadequate to meet our treaty obligations. Already, leftists in the United Kingdom are using the treaty to attack welfare cuts by the Cameron government.
